1. Acceptance of Terms
By using the Digital Viva platform (the “Service”) provided by Integrevise, you agree to be bound by these Terms of Service (“ToS”), our Privacy Policy, and any other posted guidelines.
If you do not agree, do not access or use the Service.
2. Definitions
- Platform: Integrevise’s Digital Viva platform and accompanying tools.
- User: Any individual or institution accessing or using the Platform, including students, examiners, and administrators.
- Virtual Examiner, Analytical Observation Service, Thesis Analysis Engine, and other tools are defined as explained in the product description.
3. Eligibility
Users must be at least 18 years old, or otherwise legally capable, and authorised by their educational institution to use the Service.
4. User Accounts & Access
- Users are responsible for securing their login credentials.
- You agree to provide accurate, complete, and current information.
- Integrevise may suspend or terminate accounts at our discretion for violations of the ToS or misuse.
5. Use of the Platform
- The Platform is provided for academic assessment purposes only.
- Users agree not to reverse-engineer, hack, or misuse the system.
- Students consent to monitoring features: facial recognition, browser activity, computer vision analytics.
Non-consensual use is prohibited.
6. Intellectual Property
- The platform, AI models, content, and software are Integrevise’s exclusive property or its licensors’.
- Users retain ownership of their own input (e.g., student responses), but grant Integrevise a royalty‑free license to process them for assessments and platform improvement.
7. Monitoring & Privacy
- For academic integrity, we collect: live video, browser logs, identity verification data, and performance metrics.
- Use and retention of data are governed by our Privacy Policy.
- Institution administrators may access data as allowed by configured permissions; you authorize such disclosure.
8. Security Configurations
- Institutions may set monitoring intensity thresholds, alert rules, and data access levels.
- Users must not attempt to circumvent or disable monitoring features.
9. Limitation of Liability
- To the maximum extent permitted by law, Integrevise and its affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages.
- In no event shall Integrevise’s total liability exceed fees paid (if any) by the institution using the Platform in the preceding 12 months.
10. User Obligations
- Provide truthful information during identity verification.
- Use the platform in compliance with institutional rules.
- Report system issues immediately.
- Do not misuse or tamper with the Platform’s integrity technologies.
11. Human Oversight & Overrides
- The Analytical Observation Service may flag issues or provide low confidence scores; these prompt human examiner review.
- Examiners may override system outcomes, but must comply with ethical/institutional policies.
12. Privacy & Data Protection
- We follow applicable data protection laws (e.g., GDPR, FERPA).
- Users may request export or deletion of their personal data as allowed by law and institutional policy.
13. Termination
- Integrevise may terminate or suspend access at any time for breach of these ToS or misuse.
- Users may terminate by ceasing use and requesting account deletion.
- Relevant provisions (e.g., IP, liability limits) survive termination.
14. Modifications to ToS
- We may revise these ToS; updated versions are posted here.
- Continued usage 14 days after posting updates means acceptance of new terms.
15. Governing Law & Dispute Resolution
- These ToS are governed by the laws of England and Wales (adjustable to institution locale).
- Disputes should first be addressed via good‑faith negotiation. If unresolved within 60 days, they may proceed via arbitration or court as agreed.
